Terms and Conditions for “Travel eSIM” Service

General Information

Service Provider Details

TELEMETEOR Energy Management and Communication Services Limited Liability Company (registered office: 1044 Budapest, Julianus barát utca 1/B, 4/49, Hungary; court of registration: Registry Court of the Budapest Regional Court; company registration number: 01-09-963367) – hereinafter referred to as the “Service Provider” – provides the services described in these General Terms and Conditions (“GTC”). The terms and conditions governing the Service Provider’s services are exclusively set out in this document.

Availability of the General Terms and Conditions

The Service Provider’s General Terms and Conditions are accessible on its website: www.telemeteor.com.

Definition

“App” refers to:

  • the software application titled “Telemeteor Travel eSIM,” which allows access to and use of the Services, and
  • (ii) the Service Provider’s official website, located at www.telemeteor.com.

“Data Plan” refers to the mobile internet bandwidth (“data”) offered by the Service Provider. This is based on mobile internet and roaming services provided by Third-Party Service Providers. This version preserves the original meaning while improving readability and aligning the language with standard legal drafting practices. You can share the next page whenever you’re ready!

“e-SIM” or “e-SIM technology”: Refers to the Subscriber Identification Module (“SIM”) embedded in the User’s mobile device. This module enables the User to access mobile internet services in the destinations selected and prepaid via the Website.

“Platform”: Refers collectively to the Application and the Website operated by the Service Provider.

“Service(s)”: Encompasses Data Packages, e-SIM Technology, and any other services made available through the Application or Website.

“Website”: Refers to the proprietary website of the Service Provider, accessible at www.telemeteor.com, through which the User can purchase Services.

“Third-Party Service Providers”: Includes local and global operators of mobile networks, providers of mobile and roaming services, intermediaries, partners, agents, subcontractors, or any other third parties whose products, services, or content are offered or displayed on the Platform.

“User”: Refers to a natural or legal person who has registered on the Application, uses the Services, and agrees to be bound by these GTC.

“Service Provider”: Refers to TELEMETEOR Energy Management and Communication Services Ltd., a Limited Liability Company that operates the Platform and resells Data Packages provided by Third-Party Service Providers using e-SIM technology.

Services Available Through the Platform

Registration and Data Package Selection

To access and use the Services, the User must register in the Application by providing a valid email address. The User can select a desired Data Package from the options available on the Platform. Each Data Package specifies:

  • The amount of data included.
  • The validity period of the package.

The User may select the Data Package that best suits their needs. Services are only available in the countries listed under the purchased Data Package and within the parameters assigned to it.

Purchase of Data Packages and e-SIM

After registration and selection of a Data Package, the User must complete the purchase of the chosen Data Package and associated e-SIM. Payments are processed via Stripe, an external financial service provider, to which the User is redirected for secure payment.

Delivery and Activation of e-SIM

Upon successful payment, the User will receive:

  • A QR code
  • An “Apple Quick Install URL”
  • An An activation code (for manual installation)

These credentials will be delivered electronically. It is not possible to collect the QR code in person.

The e-SIM must be embedded into the User’s mobile device by scanning the QR code, via Apple Quick Install URL or manually entering the activation code.

User’s Responsibilities

  • It is the sole responsibility of the User to ensure that their mobile device fully supports and is compatible with e-SIM technology.
  • The User must verify that their device is not restricted from e-SIM activation by User’s operator or any other service provider, as outlined in Clause 6.5 of these GTC.

Prepaid Services and Data Package Expiration

The Service Provider offers its Services exclusively on a prepaid basis. If the User exhausts their Data Package, they may purchase an additional package. Any unused data remaining at the end of the validity period of a Data Package will expire, and the User will not be entitled to a refund or rollover of unused data.

The available Data Packages are listed in Section 3.1 of these GTC and Annex 1, which specifies the validity period for each package. Roaming and internet services can only be used in the country(ies) included in the purchased Data Package. A detailed breakdown of Data Packages, including expiration dates by country or region, is available in Annex 1 on the Service Provider’s website: www.telemeteor.com.

Payment Processing

Payments for the Services are processed by Stripe, a third-party financial service provider, in accordance with its Terms of Service. A purchase will only be considered valid once payment has been successfully processed and confirmed by Stripe. If payment is not completed or Stripe does not provide timely confirmation, the purchase will be deemed void.

The Service Provider assumes no liability for invalid purchases. Any claims related to payment issues must be addressed directly with Stripe under its Terms of Service (stripe.com).

Before completing a purchase, the User is required to provide the following information

  • For Individuals: Full name, address, and email address.
  • For Companies: Company name, tax number, registered office address, and email address.

The accuracy of the information provided is the sole responsibility of the User. Invoices will be issued electronically based on the data provided and sent to the User’s registered email address.

Acceptance of Terms

By accessing the Platform or any part thereof, the User acknowledges that they have read, understood, and agreed to be bound by these General Terms and Conditions. This acceptance forms a legally binding contract between the Service Provider and the User.

If the User does not accept all provisions of these Terms and Conditions, they are not permitted to access the Platform or use the Services.

User Registration

Registration Requirements

To access the Platform and use the Services, the User must complete the registration process via the Application. During registration, the User is required to provide certain personal data, including a valid email address. Additional verification steps may be required for specific features of the Application.

Accuracy of Information

The User warrants that all personal data and information provided during registration are true, accurate, and up to date. The handling and processing of the User’s personal data are subject to the Privacy Policy outlined in Annex 2 of these GTC.

Login Credentials

If the User logs into the Platform using an email and password, they are solely responsible for remembering and securely storing their credentials. The Service Provider shall not be liable for any unauthorized access due to the User’s failure to safeguard their login details.

Social Media Login

Users may register and log in to the Platform using third-party authentication via <strong>Facebook, Google, or Apple IDs.</strong> By using social media login, the User acknowledges and agrees that the Service Provider may access certain information from their linked account..

The User must not share their login credentials with third parties and is responsible for maintaining the confidentiality of their account information.

Complaint Handling and Error Reporting

Reporting Complaints and Errors

Users may submit complaints or error reports regarding the Platform and Services in writing (via post or email) or verbally (via telephone) using the following contact details:

Complaint Investigation and Response

The Service Provider shall investigate all complaints and error reports within 30 days of receipt.

Complaint Investigation and ResponseA written response, including a resolution or justification for rejection, will be sent to the User within the same timeframe.

Dispute Resolution and Conciliation Boards

If the User is dissatisfied with the outcome of their complaint, they may seek dispute resolution through independent conciliation bodies as outlined in Act CLV of 1997 on Consumer Protection. The competent conciliation body is based on the User’s place of residence or, if unavailable, the registered office of the Service Provider.

Consumer Protection Authorities

In addition to conciliation bodies, the User may submit complaints regarding consumer rights violations to the relevant Hungarian consumer protection authorities under Act XLVII of 2008 on the Prohibition of Unfair Commercial Practices. Complaints related to unfair or misleading commercial practices shall be handled by the Consumer Protection Authority.

Terms and Restrictions

User Rights and Access

By registering in the Application, the User is granted a limited, non-exclusive, non-transferable right to access and use the Platform and Services. This right remains valid for the duration of the contractual relationship between the User and the Service Provider, as governed by these GTC.

Prohibited Uses

  1. Violates any applicable local, national, or international law or regulation.
  2. Is defamatory, obscene, pornographic, misleading, deceptive, fraudulent, unlawful, offensive, hateful, or otherwise inappropriate.
  3. Infringes upon any third party's intellectual property rights or any other legal rights.

Restrictions on Use

  1. Copying, modifying, adapting, or creating derivative works based on the Platform or Services.
  2. Reverse engineering, decompiling, or attempting to extract the source code of the Platform or Services.
  3. Assigning, sublicensing, leasing, reselling, transferring, or otherwise distributing the Platform or Services to any third party.
  4. Removing, modifying, or obscuring any copyright, trademark, trade name, or other intellectual property notice displayed on the Platform or Services.
  5. Circumventing or attempting to bypass any security measures or access restrictions implemented on the Platform.

Compliance with Laws and Regulations

The User agrees to use the Platform and Services strictly in compliance with these Terms and Conditions and all applicable laws. The User shall not use the Platform or Services in any malicious, fraudulent, or unlawful manner or in a manner that contradicts these GTC.

Device Compatibility and Network Restrictions

To access the Services, the User's mobile device must be compatible with eSIM technology and unlocked for use with all mobile network operators. It is the User's sole responsibility to verify that their device is not restricted from connecting to foreign mobile providers before purchasing any Service. The Service Provider shall not be held liable for any incompatibility or network restrictions preventing the use of the Services, and the User shall have no right to make claims against the Service Provider on this basis.

Modifications to the Platform and Services

The Service Provider reserves the right to modify, update, or discontinue any part of the Platform or Services at its sole discretion. This includes:

  • Changes to content, features, or functionality.
  • Adding, restricting, or removing specific services or features.
  • Temporarily or permanently suspending the Platform or Services without prior notice to the User and without incurring liability of any kind.

Availability of Services

The Service Provider does not guarantee uninterrupted availability of the Platform, Services, or any content or information contained therein. The User acknowledges that service disruptions may occur due to technical issues, maintenance, or factors beyond the Service Provider's control.

Service Maintenance

From time to time, the Service Provider may conduct maintenance activities that could affect the availability or performance of the Services. These activities may result in temporary service interruptions or a deterioration in service quality.

Monitoring of Service Usage

The Service Provider reserves the right to monitor the User's access to and use of the Platform and Services to ensure compliance with these Terms and Conditions. Such monitoring activities may be conducted at the Service Provider's discretion, without prior notice, and without liability to the User.

Terms for Third-Party Service Providers

Role of Third-Party Service Providers

The User acknowledges that the mobile data communication, internet, and roaming services provided through the Platform are supplied by Third-Party Service Providers. The Service Provider does not operate, create, or deliver its own local or international mobile internet or roaming services. Instead, the Services are made available based on agreements between the Service Provider and Third-Party Service Providers.

Third-Party Terms and Conditions

Third-Party Service Providers operate under their own independent terms of service and policies, which the Service Provider has no control over. The User may review these terms on the respective Third-Party Service Provider's website.

Additional Agreements with Third-Party Providers

By purchasing Services, the User enters into an additional contractual agreement with the respective Third-Party Service Provider(s). By accepting these GTC, the User also agrees to be bound by the terms of service and privacy policy of the applicable Third-Party Provider. The Service Provider is not a party to these additional agreements and assumes no responsibility for their enforcement.

Suspension or Termination by Third-Party Providers

The User acknowledges and accepts that Third-Party Service Providers may, at their sole discretion and without prior notice:

  • Temporarily or permanently suspend service availability.
  • Discontinue mobile data or roaming services in specific countries or regions.

The Service Provider shall not be liable for any such suspensions or terminations. The User waives any right to assert claims against the Service Provider in connection with such actions or their consequences.

Service Modifications by Third-Party Providers

Third-Party Service Providers may unilaterally modify their services at any time, including but not limited to:

  • Changes in pricing.
  • Adjustments to data package allowances.
  • Modifications to service duration or availability.

If a Third-Party Service Provider modifies its services, the Service Provider reserves the right to update its own prices and service offerings on the Platform without prior notice. The Service Provider shall not be held liable for such modifications, and the User shall not have any claim against the Service Provider for these changes or their consequences.

Advertisements and External Links

Advertisements on the Platform

  • The Platform may display advertisements from third-party advertisers. The User acknowledges and agrees that advertisements may be personalized based on:
  • The User's activity on the Platform.
  • Information and personal data provided by the User.
  • Data collected through cookies and similar tracking technologies.
  • The User waives any claims against the Service Provider related to the display of such advertisements.
  • The Service Provider does not endorse or assume responsibility for the products or services promoted in these advertisements. Any business transactions or engagements between the User and third-party advertisers occur solely at the User's own risk and expense.

External Links

  • The Platform may contain links (hyperlinks) to third-party websites or external sources of information.
  • The Service Provider does not control, monitor, or verify the content of these external websites. The inclusion of links does not imply the Service Provider's endorsement of or responsibility for:
  • The accuracy, reliability, or legality of the content on linked sites.
  • Compliance with data protection and privacy regulations by external sites.
  • Accessing or using information from linked websites is at the User's own risk. The owners of the linked websites are solely responsible for the content they provide.
  • The Service Provider shall not be liable for any direct or indirect loss, damage, or harm arising from the User's reliance on or use of information from linked websites.

Exclusion and Limitation of the Service Provider's Liability

General Disclaimer of Liability

The User acknowledges and accepts that mobile data communication, mobile internet, and roaming services are provided by Third-Party Service Providers. As a result, the Service Provider cannot guarantee the quality, availability, or uninterrupted operation of the Services. The Service Provider shall not be liable for:

  • The adequacy or quality of the Services.
  • Any failures, interruptions, or deficiencies arising from the networks or services of Third-Party Service Providers.

No Liability for Third-Party Services

The Service Provider assumes no responsibility for the performance, availability, or quality of services provided by Third-Party Service Providers. Any issues related to such services must be addressed directly with the respective Third-Party Service Provider.

No Guarantee of Platform Performance

The Service Provider does not warrant that:

  • The Platform, Services, or any of its features will be error-free or uninterrupted.
  • The User will achieve any specific outcome or purpose by using the Platform or Services.
  • The Services will meet any particular level of quality, reliability, or suitability for a specific purpose.

"As Is" and "As Available" Basis

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Service Provider expressly disclaims any warranties, express or implied, regarding:

  • The accuracy, reliability, or availability of the Services.
  • The uninterrupted operation or fitness for a particular purpose.
  • Any liability for direct or indirect damages, including loss of data, lost profits, or business opportunities arising from the use or non-use of the Services.

Device Compatibility and Errors

  • The Service Provider does not guarantee that the User's mobile device is compatible with eSIM technology.
  • The User is solely responsible for verifying device compatibility before purchasing or using the Services.
  • The Service Provider makes no representations or warranties regarding compatibility, performance, or successful activation of eSIM technology on the User's device.

Limitation of Liability for Damages

To the maximum extent permitted by law, the Service Provider shall not be liable for any:

  • Direct, indirect, incidental, or consequential damages arising from the use or inability to use the Platform or Services.
  • Lost profits, business losses, or missed opportunities, even if such damages were foreseeable.
  • Damage to the User's device, software, operating system, or stored data resulting from the use of the Platform or Services.
  • Business interruptions, hardware malfunctions, or system failures caused by using the Platform or Services.

Maximum Liability Cap

In all cases, the Service Provider's total liability for any claims made by the User shall be strictly limited to the amount actually paid by the User for the purchased Data Package.

Platform Maintenance and Updates

Platform Maintenance

The Service Provider reserves the right to maintain, update, and modify the Platform at its own discretion.

Updates may include technical improvements, security patches, performance enhancements, or modifications to comply with legal or operational requirements.

The Service Provider shall notify Users of major updates via its website: www.telemeteor.com.

Definition of Updates

For the purposes of these GTC, updates include any modifications necessary to:

  • Ensure the Platform remains up-to-date.
  • Improve existing functions or introduce new features.
  • Maintain compatibility with third-party software or operating systems.
  • Address security vulnerabilities or compliance requirements.

Exclusions from Maintenance Responsibilities

The Service Provider shall not be responsible for errors or malfunctions arising from:

  • External damages (e.g., fire, water, or other elemental damage).
  • Physical damage caused by misuse or accidental breakage.
  • Negligence or intentional damage by the User.
  • Installation of unauthorized software or modifications performed against the Service Provider's recommendations.
  • Repairs or modifications performed by third parties without the Service Provider's authorization.
  • Malfunctions of the User's mobile device unrelated to the Platform or Services.

Modification of the General Terms and Conditions (GTC) and Contract

Right to Modify the GTC

The Service Provider reserves the right to unilaterally modify these General Terms and Conditions (GTC) at any time, at its sole discretion, and for any reason. Modifications may be made due to, but not limited to, the following reasons:

  1. Material changes in the circumstances of the Service Provider, including operational, financial, or structural changes.
  2. Significant technological developments affecting the Platform or Services.
  3. Changes in legislation or regulatory decisions requiring modifications to the GTC.
  4. Business, economic, or technical reasons affecting the Service Provider's operation or management.
  5. Changes in the prices, terms, or services of Third-Party Service Providers that impact the Service Provider's offerings.

Publication and Entry into Force of Modifications

Any amendments to these GTC, including a consolidated version incorporating the modifications, will be published on the Service Provider's website: www.telemeteor.com.

The updated GTC will be displayed in a clear, accessible, storable, and printable format at a prominent location on the website's landing page.

Effective Date: The modification shall take effect immediately upon publication and shall apply to all contracts concluded both before and after the amendment's entry into force.

User Responsibility for GTC Updates

The Service Provider is not obligated to provide individual electronic notifications to Users regarding GTC modifications.

It is the User's responsibility to check the latest version of the GTC when logging into the Application or Platform for the first time after the modification.

By accessing and using the Platform after an amendment, the User is deemed to have accepted the updated GTC.

Mutual Agreement for Contract Modifications

The Parties may mutually agree to modify any contract concluded under these GTC at any time, provided such modifications are in writing and explicitly agreed upon by both Parties.

Withdrawal Policy

Non-Refundable Payments and No Right of Withdrawal

All payments made for the purchase of the Service(s) are non-refundable.

The User has no right to withdraw from the transaction, even if the Service(s) are not used, except where withdrawal is expressly permitted by law.

Unless otherwise required by applicable consumer protection laws, the User waives any right to withdrawal under these GTC.

Completion of the Service and Cancellation Restriction

Once the eSIM is embedded in the User's mobile device (by scanning the QR code and/or manually entering the activation code), the Service(s) shall be considered fully performed and provided.

From that moment, the transaction is final and cannot be cancelled, revoked, or refunded.

Termination of Services and Contract

Duration of Agreement

These General Terms and Conditions remain binding on the User and the Service Provider as long as the User continues to access or use the Platform and/or Services.

Service Provider's Right to Modify, Suspend, or Terminate Access

The Service Provider reserves the right to:

  • Modify, suspend, or terminate the operation of the Platform or Services, in whole or in part, at any time, without prior notice, and without obligation to provide reasons.
  • Suspend or permanently terminate a User's access to the Platform or Services at its sole discretion.

The Service Provider shall not be liable for any consequences or damages resulting from such actions. These rights may be exercised, including but not limited to, cases where:

  • The User violates these GTC.
  • The User engages in unlawful or improper use of the Platform or Services.

Immediate Termination Without Notice

The User acknowledges and agrees that the Service Provider is not required to provide advance notice before suspending or terminating their access to the Platform or Services.

If the Service Provider permanently terminates the User's access, the User may not use the Platform or Services again without the explicit prior written consent of the Service Provider.

Upon permanent termination, the contractual relationship between the parties shall automatically terminate, requiring no further legal action.

Termination by Mutual Agreement

The contract governed by these GTC may be terminated at any time by mutual written agreement between the User and the Service Provider.

Miscellaneous

Validity and Severability

These General Terms and Conditions (GTC) are valid for an indefinite period and enter into force on the date of publication.

If any provision of these GTC is found to be invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.

Governing Law and Jurisdiction

These GTC shall be governed by and interpreted in accordance with Hungarian law.

The Hungarian authorities and courts shall have exclusive jurisdiction to settle any disputes arising from or related to these GTC.

Official Language

These GTC are originally drafted and executed in Hungarian. In case of any discrepancies between a translated version and the original Hungarian version, the Hungarian text shall prevail.

Applicable Laws

In matters not explicitly regulated by these GTC, the relevant provisions of Hungarian law, in particular Act V of 2013 on the Civil Code, shall apply accordingly.

Annex No. 1

Data Packages and Expiration Terms

General Provisions

This Annex forms an integral part of the General Terms and Conditions (GTC) of Telemeteor Kft. and governs the details of the Data Packages, including their validity periods and usage conditions.

The available Data Packages, pricing, and coverage details are published on the Service Provider's website and may be updated from time to time. The User acknowledges that the current packages and prices displayed on the website at the time of purchase shall apply.

Data Package Availability

The Service Provider offers regional and country-specific Data Packages, which may vary in data allowance, validity period, and geographical coverage.

The latest list of available Data Packages, their prices, and applicable countries can be found at: www.telemeteor.com

The Service Provider reserves the right to modify, update, or discontinue any Data Package without prior notice, in accordance with market conditions and agreements with Third-Party Service Providers.

Expiration and Usage Conditions

Validity Period

Each Data Package is valid for a fixed period from the time of activation on the User's device.

Unused data does not roll over after expiration.

Activation Deadline

The User must activate the eSIM within six (6) months from the date of purchase. After this period, the eSIM will expire and cannot be used.

Restrictions on Usage

Data Packages can only be used in the countries listed in the purchased plan (as shown on the website at the time of purchase).

The Service Provider does not guarantee network availability in locations outside the package's coverage area.

No Refund or Cancellation Policy

Once a Data Package is activated, the purchase is final, and no refunds, cancellations, or modifications are permitted.

If the User fails to activate the Data Package within the required timeframe, they forfeit their right to use the Service, and no compensation will be provided.

Updates and Modifications

The Service Provider may modify, discontinue, or replace Data Packages at any time.

Users are responsible for checking the latest available Data Packages and pricing on the Service Provider's website before purchase.
